In 1970, only 9 years before the Islamic Revolution took place, the “Act on the Protection of Authors, Composers and Artists’ Rights”, still in force in its entirety. On the plus side, as detailed below, both principal and neighboring copyrights can actually be enforced in the Iran. Examination of these laws and the current practice reveals, most importantly, that the situation is far from black and white, and there are still various gray areas. Nevertheless, a multitude of Iranian laws have been enacted, which cumulatively offer a degree of protection to copyright in Iran. Consequently, the Iranian legal system does not grant national and MFN treatments to foreign authors and works of art, music and literature. This is no less the case with foreign investors who intend to bring flows of money and technology into the relevant sectors of Iranian market.Īs an initial acknowledgement, it is true that Iran is neither a party to the 1886 Berne Convention for the Protection of Literary and Artistic Works, nor a member state to the 1961 Rome Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations.
